跨境代孕協議法律適用研究——兼論「兩岸四地」之相關問題

人工生殖輔助技術的進步實現了性與生殖的分離,代孕亦隨之產生,這種分離使得代孕所產生的糾紛與爭議極具特殊性與複雜性。另一方面,全球化的發展下,各法域間法律衝突的發生隨跨境民商事交往的日益密切而愈趨頻繁。此二者的結合,無疑增加了相關問題處理的困難程度,亦為國際私法上的法律適用提出了無法迴避的難題。而此一難題在日逾頻發的代孕糾紛中,得以凸顯其亟待解決的緊迫性。然目前為止,少有實踐經驗或學術見解對此一問題作出全面的回應。基於此,本文欲以跨境代孕協議法律適用問題為研究對象,探討並構想一個可行的國際私法規則。本文首先在基本問題概述中,對跨境代孕的相關概念進行界定,包括代孕、代孕類型、跨境代孕及其協議等,
敘明如糾紛產生與跨境動因等相關問題,梳理合法性與親子關係認定等法律衝突發生之處。緊接本文檢視當前既有的國際層面主要實踐,得出其指導作用存在二個不全面之處的結論,同時亦得到兒童最佳利益原則的指導性地位之啟示,並在該層面論證另一指導性原則,即親子關係法定原則應得確立的必要性,進而探討跨境代孕協議之法律適用。鑒於國際私法上存在兩種法律適用方法以解決法律衝突問題,因此本文在確立親子關係法定原則與分割法理論的應用後,對此二種方法分論之。在衝突法調整方式中,分析並構想跨境代孕此一特殊情形下,其協議親權部分與非親權部分各自之法律適用規範的合理設計;在實體法調整方式中,探析不同類型統一實體法可行性問題,並提出
相對具有可行性之方案。最後,將上述所有理論分析置於兩岸四地此一特定地理範圍中,針對其特殊性,再作進一步之調整。望透過本文之撰寫,對比分析各類相似法律關係,盡可能全面地梳理研究相關理論,有助於構建一個切實可行的跨境代孕國際私法規則,以合理妥當解決代孕在全球帶來的部分難題,使各方利益在其中均得理想的保護。此外,更望藉鄙作此一家之言,作為引玉之磚,可激起學界更多探討,早日減輕甚至避免此一複雜問題所造成的不必要之利益損害。

企業應該擔心的不是創新有無被採納,而是創新為何錯誤地被採納。無論有無科技涉入,許多創新被採用時,由於使用者認知的落差,在陌生狀態下產生曲解的意會,而造成對創新有誤會的解讀。此時,就算使用者採納創新,也不見得能夠發揮預期的效果。設計者要如何才能夠引導使用者才能有效地採用創新,成為重要議題。本研究分析國立故宮博物院商店舉辦的快閃展,了解使用者面對數位典藏所產生的誤解性採納問題。本文解析觀眾意會的三個階段:初始意會、導意作法、再意會,以便理解使用者認知歷程,如何由初始意會而後又改變原先的意會。這樣的分析需要深入理解策劃人、創新與觀眾之間的互動,探索策劃人是用什麼方式引導觀眾的認知,而運用導意的方式
重新建構觀眾的意會,最後使觀眾能有效地採納,也就是以新的方式領會博物館文物的意義。學理上,本文點出重塑使用者認知於創新採納過程中的過程,闡釋策劃人導意的作法,理解如何從觀眾認知的曲解中找到重新詮釋文物的契機,引導使用者的再意會,因而浮現新的體會。實務上,本文解讀一套策展的導意策略,藉由理解觀眾的誤會而找出改變觀眾的意會。當創新採納能知道使用者驚訝的構成,就能夠引導驚訝變成驚喜,進而讓創新採納變得有效,使博物館策展不再是不動與互動,而是產生文化上的感動。
